HADITH NUMBER 33:
الحديث الثالث والثلاثون
«عن ابن عباس رضي الله عنهما أن رسول الله صلى الله
عليه وآله وسلم قال:
لو يعطى الناس بدعواهم لادعى رجال أموال قوم ودماءهم،
لكن البينة على المدعى واليمين على من أنكر» .
حديث حسن، رواه البيهقي وغيره هكذا، وبعضه في الصحيحين.
On the authority of Ibn Abbas (RA) that the Messenger of Allah (ﷺ)
said: Were people to be given everything that they claimed, men would
[unjustly] claim the wealth and lives of [other] people. But, the onus of proof
is upon the claimant, and the taking of an oath is upon him who denies. A hasan
hadith narrated by al-Baihaqee and others in this form, and part of it is in
the two Saheeh.
Bayhaqi was the top student of Al Haakim
-who wrote the Mustadrak
-he wrote this to collect all the hadeeth that were left out by Bukhari and Muslim
-but i was warned to be careful of reading that book because it had 50
fabricated hadeeth
BIOGRAPHY OF IBN ABBASS
He was born 4 years before the hijra
-and was a paternal cousin of the Prophet (ﷺ)
-he is revered by the Muslims for his vast ilm (knowledge)
-in the field of tafseer, fiqh, hadeeth
He was the son of a wealthy merchant, Abbas ibn Abdul Mutallib
-his mother was Umm al Fadl
-she used to boast to be the 2nd woman to embrace Islam after Khadija
-and she was a close friend of hers
His father and the father of the Rasool (ﷺ) were both sons of Abdul Mutallib
-When Ibn Abbas was born, his mother took him to do tahnik
-and that is to chew a date and put into the mouth of the baby before he
started to suckle
-this was done by the Prophet (ﷺ) forming a bond between them
When he was about 7 years old the Prophet (ﷺ) hugged him and made a dua
-for Allah to teach him tafseer and ta'weel
Narrated By Ibn 'Abbas: Once the Prophet ﷺ
embraced me and said, "O Allah! Bestow on him the knowledge of the Book
(Qur'an)." [Sahih Bukhari, Vol 1, Book 3, Hadith #075]
-Allah answered this dua and so he became the commentator of the Qur'an
Sa'd ibn abi Waqqas said: “I have never seen
someone who was quicker in understanding, who had more knowledge and greater
wisdom than Ibn Abbas. I have seen Umar summon him to discuss difficult
problems in the presence of veterans of Badr from among the Muhajirin and
Ansar. Ibn Abbas would speak and Umar would not disregard what he had to say.”
[al-Tabaqat al-Kubra Ibn Sa'd (2/281-282)]
Ibn Abbas devoted himself to the acquisition and imparting of knowledge
-people would swamp his house to seek knowledge from him when he arrives in a
city
-same used to happen to A'isha, Mu'adh ibn Jabal
He couldn’t go to sleep if he knew that there was a hadith out there
-with a sahabi that he did not know about
-this is how much he was filled with zeal and enthusiasm to learn the deen
'Abdullah b. Shaqiq reported: 'Ibn 'Abbas one
day addressed us in the afternoon (after the afternoon prayer) till the sun
disappeared and the stars appeared, and the people began to say: "Prayer,
prayer." A person from Banu Tamim came there. He neither slackened nor
turned away, but (continued crying): "Prayer, prayer." Ibn 'Abbas
said: "May you be deprived of your mother, do you teach me Sunnah?"
And then he said: "I saw the Messenger of Allah (ﷺ)
combining the noon and afternoon prayers and the sunset and 'Isha
prayers."' 'Abdullah b. Shaqiq said: 'Some doubt was created in my mind
about it. So I came to Abu Huraira and asked him (about it) and he testified
his assertion.' [Sahih Muslim (1/491) No. 705]
One day when he was giving a lecture
-salatul Maghrib came and someone got up to remind him about it
-but he did not stop his dars and he joined it with Esha at Esha time
The Hanafis need to learn this hadeeth because they don’t join their salah
-so are you going to hang on to your madhab
-or are you going to follow this hadith in Sahih Muslim?
-you are allowed to join your salah if you are busy
Combining the two prayers due to some illness or
other excuse: Ahmad, Qadi Hussain, al-Khattabi, and al-Mutawali of the Shaf'i
school are of the opinion that it is allowed to combine two prayers, either
during the time of the earlier or later salah, due to illness as it is a
greater hardship than rain. An-Nawawi says: "This is a strong opinion
based on [sound] evidence." In al-Mughni it is stated: "The illness
which permits one to combine the prayers is the one which would otherwise cause
hardship and more weakness [if he prayed each salah separately]."
The Hanbali school is the most accommodating as it
allows one to combine the prayers, at the time of the early or later salah, for
one who is ill as well as for the woman who is breast-feeding and will face hardship
in cleaning her dress for every salah, for the woman who is plagued by a
prolonged flow of blood, for the person who cannot control his urine, and for
one who cannot purify himself or herself, and for the one who fears for his
life, property, or family.
Ibn Taimiyyah says: "Among the opinions the most accommodating on this
question is that of the Hanbali school which allows one to combine the prayers
if he is busy (since an-Nasa'i has related something to that effect from the
Prophet sallallahu alehi wasallam) and they also say that the cook and baker,
and so forth., may also combine their prayers if they fear their wealth (i.e.,
their investment or what they are working on) will otherwise be ruined."

-Umar (r.a) allowed the baker to join his salah if busy by the oven
Umar (r.a) used to love ibn Abbas and he made him his advisor
-he used to take him to study circles and the older men used to frown about
this
-he was a boy by then and the grown men did not like this
-Umar wanted to prove a point to them
-so he read surah Nasr to them
When comes the Help of Allah (to you, O Muhammad
(ﷺ) against your enemies) and the conquest (of
Makkah), (1) And you see that the people enter Allah's
religion (Islam) in crowds (2) So glorify the Praises of your Lord, and
ask for His Forgiveness. Verily, He is the One Who accepts the repentance and
forgives. (3) (An-Nasr 110:1-3)
Umar asked them to give a tafseer of the surah
-they gave him a literal tafseer
-but ibn Abbas didn’t agree with this and gave his own tafseer
-he said the surah means Allah سبحانه وتعالىٰ was telling the Prophet (ﷺ) his death was near
-Umar said ‘i don’t know of any tafseer better than this’
-the men stopped grumbling after this
-he was proving to them the value of ibn Abbas
Ibn Abbas (RA) narrated: Umar would ask me
(about religious matters) in the presence of the sahabah of the Prophet, Abdur
Rahman ibn Awf said to him, “Do you ask him while he is like our children?” He
said, “(You know) from where he has learnt.” Then he asked me to explain: [When
comes the help of Allah and victory. (110 :1 to the end of the surah, an-Nasr)]
I said, “Indeed, it was the term of life of Allah’s Messenger that, he was
informed, had come to the end. “And I recited the surah to the end. Umar said,
“By Allah, I do not know about it more than what you know.” [Tirmidhi 3373,
Ahmed 3127, Bukhari 3627]
This story above took place during the time of the prophet (saw)
-and ibn Abbas was about 14 years old when the Prophet (ﷺ) died
Ibn Abbas was a staunch supporter of Ali (r.a)
-and he did not flinch in his support of him
-he fought with him against Mu’awiya
-and when the Khawarij broke away from Ali's camp
-Ali sent ibn Abbas to debate them
After he debated them, 24,000 came back to the camp of Ali
When people saw him, they would say he is the most handsome
-when he taught they would say he is the most knowledgeable
-and when he spoke, they would say he is the most eloquent
THE MOST FAMOUS STUDENTS OF IBN ABAAS
1. MUJAHID
-they say he is the anointed successor of ibn Abbas
-in the field of tafseer
2. QAASIM IBN MUHAMMAD IBN ABU BAKR
-he died 108 AH
3. TA'WOOS
-the word means a peacock
-he died 106AH
-the statement people attribute to ibn Abbas, 'kufr doona kufr'
-the scholars of Islam can’t make up their mind who said it
-half said it was ibn Abbaas and the other half said it was by Ta'woos
Those who say it is said by the former used the incident of ibn Abbas
debating the Khawarij
-he said to them the kufr of Ali fighting Mu’awiya is kufr doona kufr
-but the Saudi salafis base their deen on this statement
But ibn Abbas was not talking about the Shari’ah
-because Ali did not dismantle the Shari’ah
-he was referring to the fitna of Ali and Mu’awiya
-but the Saudi salafis use this to say the apostate leaders are all inside
Islam
-because they dismantle the Shari’ah
A Saudi salafi is so evil they lie on Prophet Yusuf (a.s)
-they said he worked for the Egyptian king
-so they do not do anything wrong to work for the apostate leaders
-they also claim to join the UN is halal
-because the prophet signed the treaty of Hudaibiyya
-they are breath takingly evil
4. WAHHAB IBN MUNABBIH
-the statement 'every key has ridges' came from him
وقيل لوهب بن منبه: أليس لا إله إلا الله مفتاح
الجنة؟ قال: بلى، ولكن ليس مفتاح إلا له أسنان، فإن جئت بمفتاح له أسنان فتح لك،
وإلا لم يفتح لك
Wahb ibn Munabbih was once asked, "Isn't the statement of la ilaha
illa-llah the key to Paradise?" He answered, "Yes, but every key has
ridges. If you come with the key that has the right ridges, the door will open
for you. Yet if you do not have the right ridges the door will not open for
you.” [Sahih Bukhari, (2/71), al-Asma' wa al-Sifat al-Bayhaqi (1/274),
Hilyatul-Awliya Abu-Naeem al-Asbahani (4/66)]
The Abbasid dynasty came from the lineage of Ibn Abbas
-the caliphs Mansoor, Harun ar Rashid, Mu'tasim all were of his lineage
-this dynasty came to topple the Omayyad dynasty
-because they were the lineage of Abu Sufyan
-to bring the caliphate back to the lineage of the prophet (saw)
When they toppled the Omayyad dynasty
-they dug up the graves of all the caliphs except Mu’awiya and Umar ibn Abdul
Aziz
-the former was a sahabi
-and the latter was a very pious leader who was loved by all
Ibn Abbas died 65AH at the age of 69
SHARH OF HADEETH
This means that you can’t trust the layman with the Shari’ah
-because people make takfir when their feelings are hurt
-and making takfir on a man means he has to be killed
-because it means he has now become an apostate
-so you can’t trust the layman with the Shari’ah
People make takfir when their property is stolen
-or the honour of their family name is dragged to the gutter
Example a man met your beautiful daughter online
-and seduced her into zina and impregnated her
-this man is a faasiq but most parents would make takfir on him
-and would want to murder him
The punishment of a thief is to cut off the hand
-but a man was burnt alive with a car tyre on petrol for stealing
-but this is not the punishment for theft
-so you can’t trust the layman with the Shari’ah
In another country a cow thief was killed by dropping a big rock on his head
-his only crime was theft
Who do you trust with the Shari’ah?
-many Pakistani women are killed and majority of them are innocent
-men boast about sleeping with girls while it is a lie
-but the father of the girl would kill her to restore the honour of the family
Allah سبحانه وتعالىٰ warned us about following the majority
-because the majority, all they want to do is killing
-not to implement the Shari’ah according to the Prophet (ﷺ)
And if you obey most of those on earth, they
will mislead you far away from Allah's Path. They follow nothing but
conjectures, and they do nothing but lie. (Al-An'am 6:116)
In Palestine a boy killed his mother
-because she decided to move on after divorce with his father
-who said she should be killed?
-where in the Shari’ah did they say this?!!
-what Shari’ah is that?
So people have become so evil you can’t trust them with the Shari’ah
-the Muslims have become so weak in their emaan
-Allah (swt) did not bless them with the Shari’ah
-most of them take bribes
-where is your evidence for honour killing?
-why kill only the girl?
-why don’t you kill the boy?
-where is the hadith for honour killing?
The Muslims think killing is the solution to everything
-a man slept with my daughter, am going to kill him
-a man stole my money, am going to kill him
-so if you are a hit man in some countries, you will be a rich man
-because of the amount of killing taking place in them
-because people don’t implement the Shari’ah
If a boy seduces your wife you can’t kill him
-but if a married man seduce her then death is his punishment
-and the Islamic court has to kill him not you
-so you can’t take the Shari’ah into your own hands
The Qaadi implements the Shari’ah
-not you the lay man
This is why the Prophet (ﷺ) said if men were given what they claimed
-they would claim the lives of others
You can’t trust the Shari’ah with the ignoramus
-or the man who is weak in emaan because he is going to take bribes
-you can’t trust it to the racist because he will take sides with his race
-you can’t trust the Shari’ah to the tribalist either
A white Muslim passed a fatwa in Chechnya for the Russians to come and
invade it
-the mujahideen killed him because he was a milk shaikh
-no al walaa wal baraa
-his allegiance was to the Russians

-but no one wants to make takfir on him because he is Arab
-so you can’t trust the Shari’ah to the racist
The kuffaar are killing Muslims and humiliating the mujahideen
-these Americans say they are crusaders
-and yet Bin Baaz gave his walaa to them
-but people don’t want to make takfir on him because he is an Arab
You can’t trust the Shari’ah to a nationalist
-if you have an accident as a foreigner
-they will say you are wrong so fix the car
If we have emaan, Allah will give us Shari’ah
-we are in a predicament (no Shari’ah)
Verily! Allah will not change the good condition
of a people as long as they do not change their state of goodness themselves
(by committing sins and by being ungrateful and disobedient to Allah). But when
Allah wills a people's punishment, there can be no turning back of it, and they
will find besides Him no protector. (Ra'd 13:11)
If you want Shari’ah, return to your deen and practice it and be just
-then Allah will give you the Shari’ah
Some lies make you a kaafir but not all
-if you lie about your age to propose to a girl you are not a kaafir
-you become a kaafir when you lie on Allah or the prophet (saw)
-it is only the Khawarij who believe all lies make you a kaafir
On the authority of Safwan ibn Sulaym who said:
"The Messenger of Allah (ﷺ) was asked, 'Can the mumin be a coward?' He said,
'Yes.' He was asked, 'Can the mumin be a miser?' He said, 'Yes.' He was asked,
'Can the mumin be a liar?' He said, 'No.'" [Muwatta Malik (2/169) No.
2088, Shu'ab al-Eman al-Bayhaqi (6/456) No. 4472, Makarim al-Akhlaq Ibn Abi
al-Dunya (pg. 54) No. 147, Mishkat al-Masabih (3/1364) No. 4862]
In our love of wealth we are vicious and scrupulous
Verily! Man (disbeliever) is ungrateful to his
Lord; (Al-'Adiyat 100:6)
And to that fact he bears witness (by his deeds); (Al-'Adiyat 100:7)
And verily, he is violent in the love of wealth. (Al-'Adiyat 100:8)
-some brothers went back home to build houses
-and their family members produced papers to say they own it
-and to solve the problem, they hire a hit man
And you devour inheritance all with greed,
(Al-Fajr 89:19)
And you love wealth with much love! (Al-Fajr 89:20)
This hadith 33 is also prove that every man is innocent until proven guilty
-not the kaafir way who say every Muslim is a terrorist until proven otherwise
-but in Islam we are just
The kaafir in Europe shoots first then investigate
-this is how evil they are

The sun newspaper said when the police went to arrest a man
-the man took a gun and shot one of them

Abu Huraira narrated the Messenger of Allah (ﷺ)
said: "It is enough to call a man a liar that he narrates everything he
hears" [Sahih Muslim (1/10) No. 5, Musannaf Ibn Abi Shaybah (5/237) No.
25617, al-Zuhd al-Ahmad Ibn Hanbal (p. 41) No. 249]
This hadith is also talking about Li’an
WHAT IS LI'AAN?
-when the prophet (saw) got back from the Tabuk expedition
-a sahabi found a younger man in bed with his wife
-the sahabi was called Hilal and the culprit Shareek
-the prophet asked him to bring 4 witnesses or 80 lashes will be given to him
-but he insisted so the Qaadi had to make them do Li’an
-this means to say wallahi i caught a man with my wife in bed 4 times
-and then incur the curse of Allah on him on the 5th occasion
-the woman will do the same saying she is innocent
Narrated Ibn Juraij: Ibn Shihab informed me of
Lian and the tradition related to it, referring to the narration of Sahl bin
Sa`d, the brother of Bani Sa`idi He said, "An Ansari man came to Allah's
Messenger (ﷺ) and said, 'O Allah's Apostle! If a man saw another
man with his wife, should he kill him, or what should he do?' So Allah revealed
concerning his affair what is mentioned in the Holy Qur'an about the affair of
those involved in a case of Lian.
The Prophet (ﷺ) said, 'Allah has given His verdict regarding you and your wife.' So they carried out Lian in the mosque while I was present there. When they had finished, the man said, "O Allah's Messenger (ﷺ)! If I should now keep her with me as a wife then I have told a lie about her. Then he divorced her thrice before Allah's Messenger (ﷺ) ordered him, when they had finished the Lian process. So he divorced her in front of the Prophet (ﷺ) ." Ibn Shihab added, "After their case, it became a tradition that a couple involved in a case of Lian should be separated by divorce. That lady was pregnant then, and later on her son was called by his mother's name. The tradition concerning their inheritance was that she would be his heir and he would inherit of her property the share Allah had prescribed for him." Ibn Shihab said that Sahl bin Sa`d As'Saidi said that the Prophet (ﷺ) said (in the above narration), "If that lady delivers a small red child like a lizard, then the lady has spoken the truth and the man was a liar, but if she delivers a child with black eyes and huge lips, then her husband has spoken the truth." Then she delivered it in the shape one would dislike (as it proved her guilty). [Sahih Bukhari (7/54) No. 5309]
So they did Li'an in front of the Prophet
-when the baby was born, it resembled the lover
-this shocked the prophet
-and he said if the holy Qur'an was not between him and the woman
-he would have stoned her to death
