DARS FOUR

AYAH 12:
يَا أَيُّهَا الَّذِينَ آمَنُوا
اجْتَنِبُوا كَثِيرًا مِّنَ الظَّنِّ إِنَّ بَعْضَ الظَّنِّ إِثْمٌ ۖ وَلَا
تَجَسَّسُوا وَلَا يَغْتَب بَّعْضُكُم بَعْضًا ۚ أَيُحِبُّ أَحَدُكُمْ أَن
يَأْكُلَ لَحْمَ أَخِيهِ مَيْتًا فَكَرِهْتُمُوهُ ۚ وَاتَّقُوا اللَّـهَ ۚ إِنَّ اللَّـهَ
تَوَّابٌ رَّحِيمٌ ﴿١٢﴾
O you who believe! Avoid much suspicion, indeed some suspicions are sins. And spy not, neither backbite one another. Would one of you like to eat the flesh of his dead brother? You would hate it (so hate backbiting). And fear Allah. Verily, Allah is the One who accepts repentance, Most Merciful. (Al-Hujurat 49:12)
When Allah (سبحانه وتعالىٰ) said avoid suspicion it means the suspicion with no basis and no foundation.
For example, ten people came to you and you lost your phone, and you suspect the poorest among them just because he is poor.
You can't pick on people just because they are poor; some rich people steal too.
So, this is the suspicion Allah سبحانه وتعالىٰ has condemned in this ayah because it is baseless.
We asked our shaikhs about a man caught on camera committing zina, they said technology is so advanced that it can manipulate and distort the video to make it look like he is committing zina.
So, we need four live witnesses for the punishment to be applied as the film is suspicion and not witness.
عن ابن عباس رضي الله عنهما، قال: قال رسول الله صلى الله عليه وسلم: ادرءوا الحدود بالشبهات
Ibn Abbas (RA) narrated the Messenger of Allah (ﷺ) said: "Abandon the Hudood when there is doubt." [Musnad Abu Hanifa (Kitab al-Hudood) No. 4]
The Rasul (ﷺ) said we should drop the hudud if there is an element of doubt.
It is better for a man to get away with stealing than chop off his hand because you can't give him his hand back.
If you are a criminal investigative officer, you work with suspicion until you get to the bottom of the case.
The judge has to throw away the case
if it is based on suspicion.
Therefore, the evidence should be certainty and not doubt.
And most of them follow nothing but conjecture. Certainly, conjecture can be of no avail against the truth. Surely, Allah is All-Aware of what they do. (Yunus 10:36)
However, if the suspicion has a basis, then it is not a sin.
Spying is haram in Islam.
You are not allowed to spy on your Muslim brothers and sisters.
It has been reported that a man was brought before Abdullah bin Mas'ud (RA) because his beard was giving out smell of wine. Ibn Mas'ud said: "We have been prohibited from spying (on Muslims) and finding faults (with them). But if something is clear to us, then we punish for it." [Sunan Abu Dawud (4/272-273) No. 4890]
One night, while Umar Ibn al-Khattab was patrolling in Medina, he heard a man singing in his house. He climbed the wall of the man’s house. He found that there was a woman with him and a bottle of wine. He said to the man: “O enemy of Allah, have you thought that Allah protects you while you are disobeying Him?” The man said: “O Ameerul Mu’mineen, do not hasten! If I have committed one sin, you have committed three sins; Allah has said: (do not spy) but you have spied, and He has said: (and go into the houses by their doors) but you have climbed the wall and He has said: (when you enter houses, greet each other) but you have not greeted us.” Umar said: “Would you do me good if I forgive you?” The man said: “Yes, I would.” Then Umar forgave him and went out. Ibn Mas'ud threw a case out of court because we were commanded not to spy on Muslims and find out their faults as the kuffar do.
Some people have the habit of finding out the faults of people and spreading them.
So, this surah was revealed to instil in us good akhlaq (manners) because when you are living in a Muslim community and you have people finding out the faults of Muslims to spread them this will cause fitna in the community.
Abu Huraira reported Allah's Apostle (ﷺ) as saying: The servant (who conceals) the faults of others in this world, Allah would conceal his faults on the Day of Resurrection. [Sahih Muslim, Book 32, Hadith #6267]
Asma' Bint Yazid narrated the Prophet (ﷺ) said: "Whoever defends the honour of his brother in absence has the right over Allah to be freed from the Fire."

Some people go around spreading the faults of people and the Rasul (ﷺ) asked us to conceal the faults of our brothers.
The kuffaar (USA) spy on their allies and partners; the Germans asked if the democrats spy on each other, but this question is stupid since the democrats are the greatest hypocrites.
This spying scandal caused the Brazilian president to cancel her trip to the US.

No one likes to be spied on but these kuffaar spy on you and track your every move.
Edward Snowden was disgusted by this and exposed their hypocrisy.
The whole world sees him as a hero because it is unethical to spy on anyone.
In some countries you need a court permit to tap the phones of people.
These kuffaar spy too much because they have too much blood on their hands and they keep looking behind their shoulders.

The kuffaar spy on all the MPs and know everything about them, therefore if anyone misbehaves they will expose you and disgrace you.
David Mellow was a conservative MP who was anti-Israel in his speeches and the newspapers broke the news that he was having an affair.
These people have files about every single MP and have all your dirty secrets in them.
Even if you send a text to a girl for zina they know about it.
The kuffaar spy on each other because they blackmail you with your sins. This is their modus operandi.
If you are a son or daughter of a president or prime minister and you are sent to Harvard or other top universities, they will keep a file on you because they expect you to be something in the future.
They will have all your secrets and make sure you dance to their tunes or else they will destroy you and disgrace you like they did to Mark Oaten because he criticised the policies of Tony Blair to go to war.

In the Islamic state we don't have a multi-party system, and we don't spy on people and expose them because we are told to conceal their faults.
This is the culture of Europe and America.
Women in these countries sleep with high profile men and sell their stories.
There is no doubt that affairs happen in the Muslim world, but no Muslim woman will go and expose the story in the press.
Only an apostate will do this, and no newspaper will print it anyway because we have decency, morals, ethics and a sense of shame unlike in Europe and America.
This shows the superiority of Islam over them.
If you spy on the Muslims for the kuffaar you become a kaafir.

These people who spy for the kuffaar say it is just a job and use the story of Hatib Ibn Abi Balta as their justification. It is ijma amongst the Muslims that this makes you a kaafir.
Ibn Hazm Stated in Al-Muhalla (11/138): "What is correct is that His statement, the Most High, "And if any amongst you takes them as Auliya', then surely he is one of them." (The Quran 5:51), should be understood on the basis of its apparent meaning. The person being referred to is a disbeliever from the generality of disbelievers, and no two Muslims disagree regarding this."
Sheikh Muhammad ibn Abdul Wahab, may Allah have mercy on him, gathered ten actions that negate one's Islam (Nawaqid ul-'Ashr), the eighth one of which states: "Assisting the disbelievers (against the believers) (Mudhaharatul Mushrikeen) and supporting them against the believers (is from the actions that negates of one's faith). The Proof being the statement of Allah, "And if any amongst you takes them as Auliya', then surely he is one of them. Verily, Allah guides not those people who are the Zalimun (polytheists and wrong-doers and unjust). (The Quran 5:51)."
Sheikh Ibn Baz stated (Al-Fatawa 1/274): "There is a consensus amongst the scholars that whoever supports the disbelievers against the believers (Dhahar Al-Kuffar 'Ala Al-Muslimeen), and assists them by any means of assistance, then he is a disbeliever just like them (the disbelievers he supported)…"
When the Americans wanted to bomb Afghanistan, the Pakistanis allowed them to use their airspace and land space and shared with them all the intelligence they have on the Taliban so they know where to bomb.
This makes them kufaar; even Shaikh Bin Baaz passed this fatwa.
All the fatwas of Bin Baaz are accurate except one which he passed to allow the Dajjal army to have a military base in the holy land.
Shaikh 'Abdul-'Azeez Ibn 'Abdullah Ibn Baaz said: "There is no Eeman for the one who believes the laws of the people and their opinions are superior to the Hukm of Allah and His Messenger or that they are equal to it or that they resemble it or who leaves it or replaces it with fabricated laws and institutions invented by people, even if he believes that the laws of Allah are more encompassing and more just" [Wujoob Tah'keem Shari'ah Allah' (pg. 16-17)]
Abu Huraira (RA) reported that Allah’s Messenger (ﷺ) said: “Two characteristics cannot combine in a hypocrite: good character and an understanding of religion.” [Sunan Tirmidhi (5/49) No. 2684, al-Thiqat Ibn Hibban (8/227) No. 13149, al-Mu’jam al-Awsat al-Tabarani (8/75) No. 8010, al-Madkhal ila al-Sunan al-Kubra al-Bayhaqi (pg. 256) No. 357]
The Americans are despised because of their spying; no one likes to be spied upon.
They made all their allies upset. They are the biggest hypocrites in the world.
They never keep their promises and they are liars, hypocrites, thieves and murderers.

The recompense of those who wage war against Allah and His Messenger and do mischief in the land is only that they shall be killed or crucified or their hands and their feet be cut off on the opposite sides, or be exiled from the land. That is their disgrace in this world, and a great torment is theirs in the Hereafter. (Al-Ma'idah 5:33)
O you who believe! Take not the Jews and the Christians as Auliya' (friends, protectors, helpers, etc.), they are but Auliya' to one another. And if any amongst you takes them as Auliya', then surely he is one of them. Verily, Allah guides not those people who are the Zalimun (polytheists and wrongdoers and unjust). (Al-Ma'idah 5:51)
A spy is worse than a gay and we kill the gays in the Islamic state.
There is an exception to the rule of killing the spy and that is for reconnaissance missions.
If the Rasul didn't spy on Banu Mustalliq, he wouldn’t have known that they are planning to attack Medina.
You need to spy on your enemy and be a step ahead of them; the Jews spy on every one of their enemies.
Women make the best spies especially on their husbands.
They like to check the inboxes of their husbands, but this spying may bring to light information that will hurt you.
Very few women don't spy.
Asian and Afro-Caribbean women spy on their husbands, but Arabs and African women don't.
However, some scholars say that a father is allowed to intercept the emails of his daughter for her own protection and this is not considered spying.
Anyone who refuses to come on Skype to talk to you, he is not sincere and hence dodgy.
Allah (سبحانه وتعالىٰ) said you should not backbite one another.
There is a difference between backbiting and slandering.
Backbiting is to say something about a person behind his back which he dislikes even though what you said is true.
Slandering is to say something behind his back which he dislikes, and it is a lie; therefore, slander is worse than backbiting.
Allah (سبحانه وتعالىٰ) mentioned wealth, backbiting and slander in the same surah because you need the wealth to spread your slander.
Woe to every
slanderer and backbiter. Who has gathered wealth and counted it,
He thinks that his wealth will make him last forever! Nay! Verily, he will be thrown into the crushing Fire. And what will make you know what the crushing Fire is? The fire of Allah, kindled, Which leaps up over the hearts, Verily, it shall be closed in on them, In pillars stretched forth (i.e. they will be punished in the Fire with pillars, etc.). (Al-Humuzah 104:1-9)
When you backbite or slander a person you have to give him your good deeds on the Day of Judgment.
The reason why backbiting is so evil is because you destroy a person's character.

Life, Wealth, Honour, Aql, Lineage & Deen are all sacred things.
'Abdur-Rahmaan Ibn Muhammad Ibn Habeeb Ibn Abee Habeeb on the authority of his father, on the authority of his grandfather [who] said: I witnessed Khaalid Ibn 'Abdullah Al-Qasree - and he addressed them at Waasit - "Oh People, make sacrifice, may Allah accept it from you. Verily I am sacrificing Al-Ja'd Ibn Dirham, for indeed he claims that Allah did not take Ibrahim as a khaleel (close friend), and [that] He did not speak to Moosa. Most Perfect is He and exalted is He from what Al-Ja'd says."
Then he descended and slaughtered him. I say: And the Jahmiyyah and Mu'tazilah speak with this, and they distort the text of the revelation regarding that, and they claim that the Lord is purified of that (i.e. having spoken to Moses and taken Ibrahim as a khalil). Your deen is sacred and that is why the caliph doesn't allow people with dodgy Aqeeda to be in the Islamic state.
Ja'd Ibn Dirham lost his head because of dodgy Aqeeda.
People backbite and slander you because they are jealous of you; they can't accept Qadr Allah and they want to tell Allah who to bless
Neither those who disbelieve among the people of the Scripture (Jews and Christians) nor Al-Mushrikun (the disbelievers in the Oneness of Allah, idolaters, polytheists, pagans, etc.) like that there should be sent down unto you any good from your Lord. But Allah chooses for His Mercy whom He wills. And Allah is the Owner of Great Bounty. (Al-Baqarah 2:105)
People do not only envy you for materials gains, but they also envy you for your deen, especially the Jews.
Many of the people of the Scripture (Jews and Christians) wish that if they could turn you away as disbelievers after you have believed, out of envy from their ownselves, even, after the truth (that Muhammad Peace be upon him is Allah's Messenger) has become manifest unto them. But forgive and overlook, till Allah brings His Command. Verily, Allah is Able to do all things. (Al-Baqarah 2:109)
The Goofy Sufis and Deobandis in South Africa printed leaflets against Mufti Menk because they had a different Aqeeda from him.
The worst hatred is not racial hatred but religious hatred.
Verily, you will find the strongest among men in enmity to the believers (Muslims) the Jews and those who are Al-Mushrikun (see V.2:105), and you will find the nearest in love to the believers (Muslims) those who say: "We are Christians." That is because amongst them are priests and monks, and they are not proud. (Al-Ma'idah 5:82)
The kuffaar in Serbia massacred the Bosnians Muslims even though they were not strong Muslims.
They used to eat pork and drink alcohol, and they had No al walaa wal baraa yet still the kufaar massacred them.

Sometimes backbiting is permissible; there is no backbiting for a person who is a wicked scholar (a scholar with dodgy aqeeda).
You need to expose his wicked Aqeeda, not his personal weaknesses
Imam Dhahabi and Hafidhh Asqalani write [that]: The scholars of Hadith have different opinions about Muhammad bin Is-haaq. Yahya bin Mo’een says that he is authentic but his narration of Hadith is not good. Ali Ibn Madini says his two narrations are unknown. Nasai said that he is not strong in the knowledge of Hadith. Imam Dar Qutni said that his Hadith cannot be used as evidence.
Imam Abu Bakr said that Muhammad bin Is-haah was Qadri. Imam Hashaam and Imam Salaiman said that he was a liar. Imam Malik said that he is a liar and is a Dajjal. Abdullah bin Mubarak said, “I saw Muhammad bin Is-haaq in Masjid ul Haif, I did not go near him because people might have said that I have wrong beliefs like him.
Imam Ahmad said “When he narrates Hadith, he narrates Hadith from those people whom he never met. Imam Yahya bin Sa’eed says “I bear witness that Muhammad bin Is-haaq is a liar. He has narrated one thousand Hadith’s which no one else has narrated.”
Imam Bukhari never wrote any Hadith that was narrated by Muhammad bin Is-haaq. No one can use his narration of Hadith as evidence for halal and haraam. But there are a few people who praised him like Imam Shoba.

Concerning Kathir ibn ‘Abd Allah, Imam ash-Shafi‘i says: “He is one of the pillars of lying.” Ibn Hajar (al-‘Asqalani), Tahdhib at-Tahdhib (Dar al-Fikr), vol. 8, p. 377; Tahdhib al-Kamal, vol. 24, p. 138.
Shaykhul-Islaam Ibn Taymiyyah (rh) said: "When some people asked Imaam Ahmad bin Hanbal that they felt uneasy about criticizing people, he replied: "If I were to remain silent, how would the ignorant masses know the truth from falsehood?" [Majmoo' al-Fataawaa (28/231)]
These statements of the Imams prove that you can backbite wicked scholars and call them by their names, and this is the sunnah of Allah.
Perish the two hands of Abu Lahab (an uncle of the Prophet), and perish he! (Al-Masad 111:1)
There is no backbiting for reference in marriage, but you should not give reference until you are approached.
Fatimah bint Qays went to the Prophet ﷺ seeking marital advice when both Mu’awiyah Ibin Abu Sufyan and Abu Jahm had proposed to her. The Prophet told her, "Mu’awiyah is stingy and tight fisted) and Abu Jahm beats his women." So marry Usamah instead.

There is no backbiting for a business transaction so if someone asked you for reference about a potential business partner then you should say all you know about him.
When you backbite your brother, it is as if you are eating his flesh.
Ubaid, the freed slave of the Prophet (ﷺ), reported “Two women were once fasting during the lifetime of Allah’s Messenger, and they almost died of thirst. This was mentioned to the Prophet (ﷺ) but he turned away from (allowing) them (to break the fast). Then they were mentioned to him again, so he called for them and ordered them to vomit, i.e. throw up, what was in their stomachs. So, they both vomited and filled up a bowl with puss, blood and pieces of flesh. Then the Prophet (ﷺ) said: ‘These two fasted by refraining from what Allah made lawful for them. but they broke their fast by doing what Allah made unlawful for them. One of them sat with the other and they began to eat from the flesh of people.’” [Musnad Ahmad (5/431) No. 23703]
Allah said you should abhor backbiting the same way you abhor eating the flesh of your dead brother.
Narrated By Uqbah ibn Amir: The Prophet (ﷺ) said: "He who sees something which should be kept hidden and conceals it will be like one who has brought to life a girl buried alive." [Abu Dawood (4/273, No. 4891), al-Hakim (4/426, No. 8162), al-Bayhaqi (8/331, No. 17387), Sunan Kubra Nasa'i (4/307, No. 7281), At-Tabarani (17/319, No. 883)]
Backbiting is not a minor sin but a major sin because you smear his honour and character.
This surah
(Al-Hujurat) forbids smear, sneer and jeer.
